The Companies Act 2008 and the Draft Company Regulations 2010 will come into operation in 2010 and will change the way business is done in South Africa.
Topics to be covered:
The Companies Act 2008 also has major implications for CCs conducting business in South Africa,
such as,
• the closing off of new registrations of CCs
• the extension of the business rescue provisions to financially distressed CCs
• members will have to meet the same standard of conduct as company directors
In addition to the above examples, Schedule 3 extends the application of many of the provisions of the Companies Act to CCs – in order to operate their businesses in a compliant manner, all members of CCs must know the implications of these provisions.
