EFFECTIVE DATE 01 JULY 2021 POPI was signed by the President on 19 November 2013 and gazetted on 26 November 2013. It could be detrimental to your organization if you do not comply. You need to train all your staff on this important legislation. Non-compliance can lead to criminal and civil fines and complaints to the regulator. The Final Regulations were presented to Parliament on the 14th of December 2018. The President has proclaimed 1 July 2020 to be the POPI commencement date. It is important because a grace period of one year starts running from that date. The majority of the POPI Act (especially the sections that create compliance requirements) commences on 1 July 2020. These are sections 2 to 38; sections 55 to 109; section 111; and section 114 (1), (2) and (3).
